An Overview of Robbery, Aggravated Robbery & Texas Law

The crime of robbery is defined by Title 7, Chapter 29 of the Texas Penal Code.

ROBBERY.  (a)  A person commits an offense if, in the course of committing theft as defined in Chapter 31 and with intent to obtain or maintain control of the property, he:

  • intentionally, knowingly, or recklessly causes bodily injury to another; or
  • intentionally or knowingly threatens or places another in fear of imminent bodily injury or death.

AGGRAVATED ROBBERY.  (a)  A person commits an offense if he commits robbery as defined in Section 29.02, and he:

  • causes serious bodily injury to another;
  • uses or exhibits a deadly weapon; or
  • causes bodily injury to another person or threatens or places another person in fear of imminent bodily injury or death, if the other person is:
  • 65 years of age or older; or
  • a disabled person.

(In this section, “disabled person” means an individual with a mental, physical, or developmental disability who is substantially unable to protect himself from harm.)

Types of Robbery Offenses

  • Armed robbery involves the use of a weapon.
  • Aggravated robbery involves the use of a deadly weapon or something that appears to be a deadly weapon.
  • Highway robbery or “mugging” takes place outside and in a public place such as a sidewalk, street, or parking lot.
  • Carjacking is the act of stealing a car from a victim by force.
  • Extortion is the threat to do something illegal, or the offer to not do something illegal if a ransom of money or objects of value is not paid. Extortion is a robbery offense primarily using words instead of actions.

Home Invasion Robbery

The criminal offense of breaking and entering a residence illegally to commit a crime while the residents are at home is referred to as home invasion.  In Texas, home invasion is generally prosecuted under statues related to unauthorized and forceful entry into a dwelling. Generally, home invasion burglary is a felony, punishable by severe fines and jail time and if the perpetrator is armed, the penalty could be life in prison.

What are the Criminal Penalties for Robbery in Texas?

If an individual is convicted of robbery in the state of Texas, they’ll be sentenced under 2nd Degree Felony guidelines as prescribed by Texas Law. Second Degree Felony offenses are punishable by a prison sentence ranging from 2-to-20 years and a fine of up to $10,000.00.

If an individual is convicted of aggravated robbery in the state of Texas, they’ll be sentenced under 1st Degree Felony guidelines as prescribed by Texas Law. First Degree Felony offenses are punishable by a prison sentence ranging from 5-to-99 years and a fine of up to $10,000.00.
