A General Overview

The Texas Controlled Substances Act defines numerous manufacture & delivery offenses in addition to the punishment to be assigned to individuals adjudged as guilty.

In short, manufacture & delivery cases are enhanced drug possession offenses. This means that a person charged with possession of a controlled substance with intent to deliver will face the next most severe criminal charge than a person charged with simple possession of the same quantity.

  • Manufacture is defined in detail, but basically entails nearly any conceivable process or set of actions that promulgates the production of a controlled substance; same with delivery.
  • Delivery is also defined in great detail, but basically entails nearly any conceivable process or set of actions that promulgates the movement, storage, organization, or administration of the controlled substance(s).

Drug Trafficking, Sale, Distribution

Drug trafficking is also a crime of intent, weight and amount. If you are arrested with a set amount of any illegal drug, you can be found guilty of drug trafficking. This is true even if you didn’t sell, distribute, manufacture, or transport those drugs.

Understanding Criminal Enhancements

For example, a case involving 1-to-4 grams of heroin will be classified as a Felony in the Third Degree which carries a potential prison sentence of 2-to-10 years. However, if the individual was trafficking 1-to-4 grams of heroin, manufacturing, or selling it (delivery), their charge will be enhanced to a Felony in the Second Degree, which could mean a prison sentence of 2-to-20 years.

Drug Manufacture, Cultivation

In Texas, the penalties for drug manufacture, such as methamphetamine, or drug cultivation such as marijuana can be severe, even if only a small amount of a drug or the ingredients (such as pseudoephedrine) or equipment used to make the drugs (chemicals, cookers) is in your possession. If located near a school, additional federal penalties could be applied that may result in a mandatory minimum one-year prison sentence.
