In most instances, prescription drug offenses are Class A Misdemeanor crimes. A Class A Misdemeanor conviction could mean a fine of up $4000.00 and a maximum county jail sentence of 1 year.
However, depending on the scheduling of the substance (see Texas Drug Penalty Groups), the intent of the offender and the quantity of the controlled substance, the criminal classification of the offense could range in severity from a State Jail Felony on up to a Felony 1.
