Understanding Assault Cases & Texas Law
Assault: A General Overview
Assault is defined as any willful attempt or threat to inflict injury on another person (or their spouse) with the immediate ability to carry out the threat. This can include verbal threats and threatening behavior. A common example would be shaking a fist at another, coupled with the obvious ability to carry out the threat and the victim believing they that will be injured. This display of force would give the victim reason to fear or expect immediate bodily harm and this constitutes an Assaultive offense. Assault may be committed with actually touching, striking or doing bodily harm.
Aggravated Assault
Aggravated Assault is committed when an assault occurs with the intention of committing an additional crime or if the assault was carried out with a weapon. A person is guilty of aggravated assault if he or she attempts to cause serious bodily injury to another or causes such injury purposefully. The crime of aggravated assault is also committed when a disabled, elderly, or young child is assaulted. In short, an assault on any person that be reasonable expect to defend themselves constitutes an assault “with aggravating factors.”
Criminal Enhancements & Assault Cases
There are enhanced minimum sentences when the offense is committed against a victim who is elderly, pregnant, incapacitated, in a public vehicle such as a bus or a train, between family members, when the victim is a law enforcement or correctional officer, and in other special circumstances.
Family Violence & Domestic Assault
Domestic assault cases are especially serious matters that are best left in the hands of only the most experienced lawyers. A family violence charge may apply to an assault that involves two family members, former lovers, and people who once lived together, but don’t anymore. It’s easy for the state to ratchet these misdemeanor cases up to a felony classification making the need for an experienced family violence defense lawyer paramount.
